Epistemologists often describe subjects as being capable of adopting a third kind of categorical doxastic stance regarding whether something is the case, besides belief and disbelief. They deploy a variety of idioms in order to ascribe that stance. In this paper, I flesh out the properties that the third kind of categorical stance is supposed to have and start searching for the best ways to ascribe it. The idioms ‘suspends judgment about whether’ and ‘is agnostic about whether’, among others, are (...) found to be unfit to play the desired role. In the end, I suggest that ‘is in doubt as to whether’ is our best choice among the alternatives surveyed here. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

This article develops the concept of community lore, initially devised by the social learning theorists Jean Lave and Etienne Wenger (1991). In extending this promising but hitherto neglected aspect of their work, this article sheds light on how and why community lore sustains and propels teaching and learning in the contemporary esoteric society Sodalitas Rosae Crucis (SRC). Ethnographic findings illuminate how the situated, informal community lore becomes a pervasive learning device that underwrites individual and collective learning, as it emerges in (...) small talk, gossip, and cautionary tales, told and shared among members. Furthermore, a dynamic of tradition and innovation is at play within the community lore, as it sustains tradition while also providing a breeding ground for new ideas and practices that lead to innovation. Within the constructive tension between tradition and innovation, I delineate how community lore works as an educational resource, with explanatory value for situated learning, especially within esoteric communities of practice. Criticisms of the “container” model of pregnancy picturing female and embryo as separate entities multiply in various philosophical and scientific contexts during the last decades. In this paper, we examine how this model underlies received views of pregnancy in evolutionary biology, in the characterization of the transition from oviparity to viviparity in mammals and in the selectionist explanations of pregnancy as an evolutionary strategy. In contrast, recent evo-devo studies on eutherian reproduction, including the role of inflammation and new maternal cell (...) types, gather evidence in favor of considering pregnancy as an evolved relational novelty. Our thesis is that from this perspective we can identify the emergence of a newhistoricalindividual in evolution. In evo-devo, historical units are conceptualized as evolved entities which fulfill two main criteria, their continuous persistence and their non-exchangeability. As pregnancy can be individuated in this way, we contend that pregnant females are historical individuals. We argue that historical individuality differs from, and coexists with, other views of biological individuality as applied to pregnancy (the physiological, the evolutionary and the ecological one), but brings forward an important new insight which might help dissolve misguided conceptions. Prior research on corporate misconduct pays extensive attention to single misconduct behaviors. However, little research has addressed recidivism – the repeated behaviors of corporate misconduct. Based on institutional theory and using the context of emerging economies where recidivism plays a considerable role, we propose the path dependency of corporate recidivism and suggest that three influential factors exist: internal preconditioning, inter-organizational imitation, and the prevailing external evaluation. Our event history analysis of 1,036 listed companies in China over the period 2001–2008 statistically (...) confirms our hypotheses. Talk of ”mental representations” is ubiquitous in the philosophy of mind, psychology, and cognitive science. A slogan common to many different approaches says that representations ”stand in for” the things they represent. This slogan also attaches to most talk of "internal models" in cognitive science. We argue that this slogan is either false or uninformative. We then offer a new slogan that aims to do better. The new slogan ties the role of representations to the cognitive role played by the (...) deliverances of perception. After clarifying the new slogan and warding off some misunderstandings, we discuss how the new slogan still captures the seed of truth in the old, point to some specific misunderstandings that can be avoided, and then suggest some ways that the new slogan is useful in the project of giving a satisfying philosophical theory of representation. The paper provides a reconstruction of proof by contradiction in Kant’s pure general logic. A seemingly less-explored point of view on this topic is how apagogical proof can account for the formal truth of a judgement. Integrating the argument held by Kjosavik (2019), I intend to highlight how one can use proof by contradiction, conceived as a modus tollens, to establish the logical actuality (logical or formal truth) of a cognition. Although one might agree on the capacity of the proof (...) to prove formal falsity, the logical actuality of a judgement is assessable based on a logically grounded judgement and, as for transcendental logic, this cognitive operation has to presuppose the real possibility of an object. Este artigo aborda a carreira, interesses profissionais e o contexto sócio-político em que viveu Ludwik Fleck A seguir, foca nos conceitos de “estilo de pensamento” e “coletivo de pensamento” que fazem parte de sua epistemologia. O objetivo é a partir deles e de outros elementos da epistemologia de Fleck compreender o processo histórico-cultural envolvido no negacionismo científico em relação à vacina. Para isso, utilizaremos alguns exemplos históricos. Consideramos que o movimento antivacinas é representado por um grupo de pessoas que pertencem, (...) predominantemente, a círculos exotéricos em termos políticos, expressando dogmaticamente os interesses políticos desses grupos. Os manifestantes contra a vacina se posicionam como defensores das liberdades individuais, desconfiando da máquina pública e compreendendo o estado como uma entidade controladora e invasiva. In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. The importance of socio-economic impacts from the introduction and use of genetically modified crops is reflected in increasing efforts to include them in regulatory frameworks. Aiming to identify and understand the present knowledge on SEI of GM crops, we here report the findings from an extensive study of the published international scientific peer-reviewed literature. After applying specified selection criteria, a total of 410 articles are analysed. The main findings include: limited empirical research on SEI of GM crops in the scientific (...) literature; the main focus of the majority of the published research is on a restricted set of monetary economic parameters; proportionally, there are very few empirical studies on social and non-monetary economic aspects; most of the research reports only short-term findings; the variable local contexts and conditions are generally ignored in research methodology and analysis; conventional agriculture is the commonly used comparator, with minimal consideration of other substantially different agricultural systems; and there is the overall tendency to frame the research upon not validated theoretical assumptions, and to over-extrapolate small-scale and short-term specific results to generalized conclusions. These findings point to a lack of empirical and comprehensive research on SEI of GM crops for possible use in decision-making. Broader questions and improved methodologies, assisted by more rigorous peer-review, will be required to overcome current research shortcomings. (shrink)

En este trabajo se analiza el recurso a la escatología y al universo profético-apocalíptico de orientación antiliberal durante la consumación de la independencia de México, en 1821. Las diversas fuentes impresas utilizadas revelan la importancia que adquirieron los discursos sibilinos en la transición del virreinato al Imperio, así como su potencial movilizador. Se argumenta que estos sirvieron para denunciar el liberalismo revolucionario, fomentar la alternativa emancipadora y proponer lecturas mesiánicas renovadas. A privileged element of contemporary law, confession as a means of proof in criminal proceedings is the object of analysis in this research. Based on a bibliographic review, the study will seek to decompose and reorganize the object on two fronts, constructing a theoretical hypothesis that proposes to observe confession as an inquisitorial practice of an institution, but which also has a traceable genealogical depth in the modulations of subjectivation techniques. The notion of the care of the self that Michel (...) Foucault referred to unfolds in Christian ethics and asceticism, reorganizing the sense of care of the self and slowly, as Christian philosophy developed and the influence of the Catholic Church in the state grew, make the act of confession loaded with an institutional-subjective double, elements that allow Zaffaroni to observe the apparent neutrality of contemporary justice as a facade for an authoritarian state and adept at inquisitorial practices, especially in matters of criminal justice. The development of computer science has raised ethical concerns regarding the potential negative impacts of machine learning tools on people and society. Some examples are pornographic deepfakes used as weapons of war against women; pattern recognition designed to uncover sexual orientation; and misuse of data and deep learning by private companies to influence democratic elections. We contend that these three examples are cases of automated evil. In this article, we defend that the concept of forbidden knowledge can help to inform (...) a coherent ethical framework in the context of machine learning research. We conclude that restricting generalised access to extensive data and limiting access to ready-to-use codes would mitigate potential harms caused by machine learning tools. In addition, the notions of intersectionality and interdisciplinarity should be systematically introduced in data and computer science research. (shrink)

Este artículo pretende analizar, el proceso de mercantilización y comercialización del carnaval de Ouro Preto, Minas Gerais (MG), Brasil, en el cual la juventud y las características que le son socialmente atribuidas emergen en un escenario festivo, influenciado principalmente por la industria del entretenimiento. Para ello, se realizó un estudio del carnaval de esta ciudad del año 2009, desde un enfoque cualitativo, combinando las investigaciones bibliográfica, documental y de campo. Sin desconsiderar las múltiples posibilidades de apropiación de los sujetos en (...) el diverso y plural tiempo-espacio de la fiesta, se identificó que las variadas formas específicas de ser joven, sus looks y estilos de vivenciar el carnaval, son el principal producto a ser vendido en el mercado de la diversión y del entretenimiento. La fiesta, que hasta hace muy poco tiempo ocurría en las calles de la ciudad, con posibilidad de participación gratuita, se transforma así en mega-producciones pagadas, privadas y destinadas principalmente al público joven. Assessment in ethics education faces a challenge. From the perspectives of teachers, students, and third-party evaluators like the Accreditation Board for Engineering and Technology and the National Institutes of Health, assessment of student performance is essential. Because of the complexity of ethical case analysis, however, it is difficult to formulate assessment criteria, and to recognize when students fulfill them. Improvement in students’ moral reasoning skills can serve as the focus of assessment. In previous work, Rosa Lynn Pinkus and Claire (...) Gloeckner developed a novel instrument for assessing moral reasoning skills in bioengineering ethics. In this paper, we compare that approach to existing assessment techniques, and evaluate its validity and reliability. We find that it is sensitive to knowledge gain and that independent coders agree on how to apply it. (shrink)

Whereas initially his contributions were sidelined by the empirical advancements of the molecular revolution in developmental and evolutionary biology, his theoretical insights have left a lasting impact on the discipline. Resumo: O presente artigo se destina a tratar do tema da evidência na fenomenologia de Husserl e busca mostrar como essa questão torna-se objeto de uma disciplina fenomenológica especial chamada “fenomenologia da razão”. O texto discute de início a tripla estratificação da lógica feita por Husserl: morfologia pura dos juízos, lógica da não-contradição e lógica da verdade, com o intuito de situar o lugar ocupado pela questão da evidência em sua relação com a lógica e com a concepção fenomenológica de (...) verdade. As 8 seções que vão na sequência dessa discussão ocupam-se, respectivamente, com a dupla redução da evidência na lógica e no psicologismo; com a evidência como princípio; com o simbolismo da lógica; a análise da linguagem e a caracterização fenomenológica dos atos de consciência; a evidência e o ideal da adæquatio; a evidência como efetuação intencional do autodado; a hierarquização fenomenológica das evidências, e seus dois principais modos na adequação e na apoditicidade. Por fim, mostramos como a análise das evidências leva à fenomenologia da razão. The text at first discusses the triple stratification of logic made by Husserl: pure morphology of judgments, logic of non-contradiction and logic of truth. It aims situating the place occupied by the question of evidence in its relation to logic and phenomenological conception of truth. The 8 sections that follow this discussion are concerned, respectively, with the double reduction of evidence in logic and psychologism; with evidence as a principle; with the symbolism of logic; the analysis of language and the phenomenological characterization of acts of conscience; the evidence and ideal of adæquatio; evidence as the intentional realization of self-data; the phenomenological hierarchization of evidence, and its two main modes in adequacy and apodicticity. Finally, we show how the analysis of the evidence leads to the phenomenology of reason. Introductions to epistemology routinely define knowledge as a kind of belief which meets certain criteria. In the first two sections of this article, I discuss this account and its application to religious epistemology by the influential movement known as Reformed Epistemology. In the last section, I argue that the controversial consequences drawn from this account by Reformed Epistemology offer one of the best illustrations of the untenability of a conception of knowledge as a kind of belief. I conclude by sketching (...) an alternative account of cognition which also provides a different framework for religious epistemology. (shrink)

Tendo como ponto de partida a obra de René Girard, o presente artigo pretende apresentar a dimensão antropológica presente na obra deste autor, destacando a sua originalidade e novidade ao pensar o homem como animal socialmente desejante. A teoria mimética, como Girard a formula, pretende ser uma teoria que, colocando no centro da sua reflexão o desejo e a imitação, permita compreender como se estruturam as sociedades arcaicas e actuais, partindo de mecanismos marcadamente antropológicos, para afirmar que as sociedades se (...) estruturam a partir do desejo, do sacrifício e da necessidade de existência de «bodes expiatórios». A partir deste pressuposto, o sacrifício é a primeira instituição humana, com a capacidade farmacológica de preservar a sociedade e de permitir a sua subsistência no tempo. A cultura, por seu lado, emerge a partir do desejo mimético; e o mecanismo do bode expiatório, mecanismo vitimário por excelência, regula a sociedade ao solucionar as suas tensões internas. Considerando estes três conceitos – sacrifício, desejo mimético e mecanismo do bode expiatório – este artigo expõe o modo como se relacionam estes conceitos. Apesar de constatar a sua presença e eficácia na história, Girard não os legitima de jure, desvelando o segredo da sua eficácia – a ignorância inocente das vítimas – que, paradoxalmente, persiste mesmo depois de denunciada nas suas escusas razões. Posto isto, perguntemo-nos: como proteger o homem da sua própria violência? (shrink)
